Alabama Divorce Laws

In order to file for divorce in Alabama, you or your spouse must live in the state for at least six (6) months prior to filing.

A no-fault divorce is one that neither spouse needs to prove that the other is the cause for the divorce. All that needs to be proven in a no-fault divorce is that an incompatibility exists between both spouses and the that the marriage is irretrievable broken.

In Alabama, you have two (2) types of divorce; uncontested and contested.

With an uncontested divorce, both parties are in agreement on all relevant issues such as child custody and support, the division of marital property, and more. This type of divorce is faster, easier, and less expensive than a contested divorce.

A contested divorce is one in which a couple doesn’t agree on at least one of the issues of divorce (e.g. child custody, child support, alimony, etc.). A contested divorce can be resolved through mediation, but if that doesn’t work , then the divorce will have to be heard by a divorce judge; which will take time and result in a more expensive process.
